Die Autorin berichtet über die Jahresstatistik zur Begutachtung der Fahreignung. Die Bundesanstalt für Straßenwesen (BAST) erstellt und veröffentlicht diese Statistik seit dem Inkrafttreten der Fahrerlaubnisverordnung 1999. Die Jahresstatistik vermittelt einen Überblick über die Verteilung der verschiedenen Anlassgruppen, die einer medizinisch-psychologischen Untersuchung (MPU) zugewiesen werden, sowie eine Zusammenfassung der Ergebnisse der MPU-Gutachten. Im Jahr 2002 führten die 17 aktiven Träger der bundesdeutschen Begutachtungsstellen für Fahreignung (BfF) insgesamt 112.539 medizinisch-psychologische Untersuchungen durch.
The DRUID expert consensus established recommendations on how to define limits for psychoactive substance use in traffic. The European DRUID project established a group of experts who are members of national working groups for defining analytical and/or risk thresholds. This group evaluated the results of DRUID, scientific literature and the experience of representatives of several EU Member States and Norway in determining cut-off levels. 1. Cut-offs should be defined for the most frequently used psychoactive substances; 2. In order to achieve compliance of the population towards cut-off regulations, they should be clear and comprehensible, pointing out the risks when used in traffic; 3. Thus, the definition of cut-offs should be based on current scientific knowledge; 4. The lowest substance concentration exerting an effect on driving should be preferred instead of the lowest limit of quantification/ detection; 5. For all psychoactive substances including alcohol, the same risk should be accepted. When a country intends to determine per se cut-off levels, several considerations have to be taken into account. From a scientific point of view, the same risk should be anticipated for all psychoactive substances including alcohol. Nevertheless, every cut-off discussion should address the question if the DRUID approach, to determine risk thresholds equivalent to alcohol limits, is feasible for the respective case.
The 6th RFP project DRUID aimed at supporting European transport policy makers by suggesting scientifically based recommendations to combat impaired driving. The main DRUID objectives were: 1. In-depth analysis of the problem situation with regard to DUI/DUID in Europe; 2. Assessment of prevalence and accident risks of DUI/DUID on the basis of epidemiological and experimental studies; 3. Evaluation of oral fluid screening devices and cost-benefit analysis of a strengthened drug driving enforcement; 4. Development of a classification system for medicines; 5. Evaluation of driver rehabilitation schemes and strategies of licence revocation; 6. Assessment of the effectiveness of new prescribing and dispensing guidelines for medicines; 7. Ddevelopment of policy recommendations on the basis of DRUID results. All in all, the DRUID results revealed that prevalence of psychoactive substance consumption, DUI/DUID, enforcement levels and legal strategies are very heterogeneous in European countries. Nonetheless, DRUID derives general recommendations as base for national solutions.
Der Nachweis von Geringstmengen Benzoylecgonin (BZE) deutet bei Gelegenheitskonsumenten nicht zwingend auf eine akute Verkehrssicherheitsgefährdung hin, zumal der kokainerge Metabolismus starken interindividuellen und geschlechtsspezifischen Schwankungen unterliegt (BOWMAN et al., 1999; LUKAS et al., 1996; HAMILTON et al., 1977) und die gemessene BZE-Konzentration vom Zeitpunkt der Kokaineinnahme und der Höhe der eingenommenen Kokaindosis abhängt (ITEN, 1994; AMBRE, 1985). Eine starke interindividuelle Varianz wurde auch bei der Einlagerung von Kokain oder BZE in Haaren festgestellt (HARKEY, 1995). Im Gegensatz zu den Gelegenheitskonsumenten weisen Kokainabhängige in einem Abstinenzraum von mindestens drei Monaten neurologische, neuropsychologische und teilweise auch psychiatrische Defizite auf, die verkehrssicherheitsrelevant sind. Somit würde bei bekannter Kokainabhängigkeit der Nachweis von Geringstmengen BZE bereits ein ausreichender Indikator für eine verkehrssicherheitsrelevante Funktionsbeeinträchtigung sein.
Das Unfallgeschehen der Radfahrer wird analysiert. Ein erheblicher Anteil der Unfälle ereignet sich ohne Beteiligung motorisierter Fahrzeuge als Alleinunfall, bei Kollisionen mit Fußgängern oder Radfahrern. Viele Alleinunfälle werden nicht angezeigt, daher gibt es eine große Dunkelziffer. Das Schwergewicht der unfallbeteiligten Radfahrer liegt bei Kindern/Jugendlichen und bei Senioren. Der Anteil der Radfahrer als Hauptverursacher liegt bei ca. 47%. Hauptunfallstellen sind Kreuzungen und Einmündungen mit je über 28 %. Auf gesonderten Radwegen ist das Radfahren nur wenig sicherer als auf Straßen ohne Radwege; hinsichtlich der Unfallschwere ist das Bild uneinheitlich. Das Unfallgeschehen an Knotenpunkten wird genauer beschrieben.
Various kinds of demerit point systems have been developed and implemented in European countries, aimed at tackling repeat offences in road transport by acting as a deterrent and providing sanctioning. The impact of a demerit point system on the number of crashes is often reported to be significant, but temporary. The objective of the EU BestPoint project was to establish a set of recommended practices that would result in a more effective and sustainable contribution of demerit point systems to road safety. A high actual chance of losing the licence and a high perceived chance of losing the licence are basic prerequisites for the effective operation of demerit point systems. For measures applied within the context of a demerit point system, a four-step-approach is recommended: warning letter, driver improvement course, licence withdrawal, rehabilitation course. Further recommendations concern issues like points and offences, e.g. which offences should lead to points, target groups, and the administration of demerit point systems. The final result of the EU BestPoint project is a handbook (van Schagen & Machata, 2012) which provides a concise overview of all recommended practices. The presentation/paper outlines how sustainable safety improvements can be achieved if national demerit point systems are implemented and maintained according to the recommended practices. In addition, potential further steps towards an EU-wide demerit point system (cross-border exchange on points and/or offences) are presented.
Die Transparenz der MPU, und damit des gesamten Systems des Führerscheinrückerhalts, stand in der Vergangenheit vielfach in der Kritik. Einen wesentlichen Beitrag zur Erhöhung der Transparenz liefert die frühzeitige Aufklärung der Betroffenen. Hierzu hatte die BASt im Rahmen einer Arbeitsgruppe neutrale Informationen rund um die MPU für die Zielgruppen Alkohol-, Drogen- und Punkteauffällige zusammengetragen und im Internet (www.bast.de/mpu) bereit gestellt. Ein diese Maßnahme sinnvoll ergänzender Schritt in Richtung Transparenz wären (rechtliche) Regelungen im Bereich der Fahreignungsberatung und fahreignungsfördernden Maßnahmen. Hierzu hat das BMVI die BASt beauftragt, die Arbeitsgruppe fortzusetzen, um ein Konzept zur Qualitätssicherung zu entwickeln. Von der Arbeitsgruppe der BASt wird eine Beratungspflicht bei jedem Entzug/Verzicht der Fahrerlaubnis als Voraussetzung für die Neuerteilung als sinnvolle Maßnahme zur Erhöhung der Verkehrssicherheit empfohlen. Zu einer Verankerung der Beratung im Normensystem wird vorgeschlagen, dass der Nachweis über die Teilnahme bei Antragstellung auf Neuerteilung einer Fahrerlaubnis vorgelegt werden müsse. Die Beratungsinhalte sollten dann in der Fahrerlaubnisverordnung (FeV) definiert sein und die Behörde müsste unmittelbar nach Kenntnis des belastenden Ereignisses den Betroffenen auf die Beratungsverpflichtung hinweisen. So hätte man eine kostengünstige und individuell angemessene Variante als ersten Schritt zur Förderung der Fahreignung. Eine solche Erstberatung sollte Anbieter-neutral erfolgen. Eine Anerkennung von Beratern kann analog den -§-§ 36, 43 FeV oder -§ 4a StVG erfolgen. Da es im Bereich der gesetzlich geregelten verkehrspsychologischen Tätigkeiten äußerst ähnliche Qualifikationsanforderungen gibt, jedoch auf jedwede Tätigkeit beschränkte Anerkennungsverfahren zu durchlaufen sind, wäre ein einheitliches Anerkennungs- und Überwachungsverfahren wünschenswert. Operationalisiert werden könnte dies im Rahmen eines Paragrafen "Verkehrspsychologen--§ (VerkehrsPsych-§)", der im StVG verankert wird.
The practicability and feasibility of using alcohol ignition interlock devices has been discussed for more than 15 years in Germany. Thereby, judicial issues have been treated conversely. Consensus exists about the fact that the voluntary use of alcohol ignition interlocks is in all areas of possible use recommendable. Great reservation is shown concerning the operation of the devices for DUI (Driving Under Influence) offenders. Main doubts regard the missing legal base for application in such cases and potential circumvention attempts while the need of supportive psychological measures is unquestioned. In 2011, the Ministry of Transport, Building and Urban Affairs entered this topic in its newly released traffic safety programme as a matter of future research. Almost in parallel, the Federal Highway Research Institute (BASt) launched an alcohol ignition interlock project for DUI offenders. The study at hand aimed at developing a comprehensive programme concept for the use of alcohol ignition interlocks as additional measure to psychological rehabilitation for DUI offenders. Expert surveys serve as input for the establishment of a widely accepted innovative concept for nationwide implementation. By means of a pilot trial, the added value of using a combination of structural (alcohol interlock) and individual (psychological measure) intervention for DUI offenders to the existing countermeasure system should be studied. In addition, selection criteria for DUI offenders eligible for future programme participation should be defined. The majority of the experts evaluate the introduction of alcohol ignition interlocks as a good option to enhance traffic safety. The possibility of early psychological rehabilitation is emphasized in the process. Those who do not approve alcohol ignition interlock usage estimate the amount of offenders eligible for such programmes too small. The survey also revealed that legal regulations for issuing an alcohol interlock restricted licence to DUI offenders is missing. Hence, a possible amendment to the German Driving Licencing Regulation was developed within the project. Consultations with the Ministry of Transport, Building and Urban Affairs and the Ministry of Justice disclosed the need for a change of the road traffic law before an amendment to the existing regulations may be put into force. At least, the person responsible in the Ministry of Justice developed a proposal for the law section that needs revision. All in all, it became clear within the process of the project that a field trial in Germany is still a distant vision. Nevertheless, all institutions involved are motivated to deal with the matter further on in order to pave the way for a soon start of the pilot trial.
This study was one part of the research activities of work package 5 "Rehabilitation" of the integrated EU DRUID project (6th Framework Programme). It aimed at gathering information about the cognitive"affective and behavioral processes that participants undergo while attending driver rehabilitation (DR) programs. The primary objective was to analyze the outcomes of group interventions for alcohol offenders in order to assess any cognitive, motivational and behavioral modifications within individual participants and to identify the relevant variables which initiate and support this change process. The general methodological concept of the study was a prospective cohort design of participants of group-based European driver rehabilitation programs, carried out via a participant feedback questionnaire survey. In total N=7.339 DUI offenders in 9 European countries (Austria, Belgium, France, Germany, Great Britain, Hungary, Italy, Netherlands and Poland) participated in the survey. The results indicate that DR participants feel such programs provide strong support for their cognitive and behavioral change processes. The findings suggest that participants feel encouraged to establish new behavioral goals and the commitment to stick to them. At the same time, the participants' ratings emphasize the important role of the course leader in encouraging such changes. The findings of this explorative questionnaire survey are promising. Although it is impossible to draw any conclusions regarding long-term behavioral changes or effects on recidivism rates, participants of DR courses express positive feedback on completion of the program. The positive outcomes of the study can motivate decisionmakers to launch DR measures and to regard them as an essential part of a comprehensive countermeasure system against DUI.
Anhand verkehrssicherheitsrelevanter, wirtschaftlicher und juristischer Überlegungen werden Bedenken seitens des Gesetzgebers bezüglich einer Einführung von Regelungen für den Einsatz atemalkoholgesteuerter Wegfahrsperren (Alkohol Interlocks) in Deutschland verdeutlicht. Dabei wird auf die Anforderungen, die hinsichtlich der Kosten und Qualität der Produkte gestellt werden, aufmerksam gemacht. Darüber hinaus wird die derzeit geltende Rechtslage, die eine Nutzung von Alkohol Interlocks im Rahmen der Begutachtung der Fahreignung und begleitender rehabilitativer Programme für Trunkenheitsfahrer möglich erscheinen lässt, dargestellt. In diesem Zusammenhang wird auf die Anforderungen an das Qualitätsmanagement, vor allem im Bereich der Qualitätssicherung, etwaiger Interlock-Programme für Trunkenheitsfahrer hingewiesen.
